Medical negligence by Doctor in private hospital in Delhi

The term 'Medical Negligence' refers to the wrongful actions and ommissions made by the Doctors while dealing with patients. It is not a term defined or reffered to anywhere in any of the enacted Indian laws. As far as the laws are concened, Doctor can be prosecuted under different sections provided for in the Indian Penal code pertaining to causing death to patient due to negligence.

Medical culture encourages doctors to avoid admitting mistakes. If one becomes victim of such medical negligence, one starts to lose faith in the honesty of profession and thus compelled to believe that medical profession is taking the shape of running business where the only purpose is to earn profit and no care to the patient. This has been further reinforced by the funds flow from the Govt.(done wisely) but increased the profits of mainly private hospitals which are being run by big corporates/companies, whose main focus is on raising the value of its shares in stock exchanges.

In fact, Doctors go on their own predictions and decide whether a mistake is a big enough to reveal to patient or to their relatives. The culture of medicine frowns on admitting mistakes usually due to fear of malpractice lawsuits.

It appears that Sr. Doctor who is supposed to perform the surgery never do it rather occassionaly advise Jr. Doctors to perform the act, due to misuse of their ego and respect which they get from the patient. This results into serious faults causing death to the patient which they never admit. The most common reason given to cover up their faults are (given hereunder) which I have faced in connection my wife's case at Escorts Fortis hospital, Okhla, New Delhi in October 2021. She was admitted for removal of stone in Gal bladder (half an hour surgery) have completely blasted the case due to medical negligence that she was kept in ICU for 35 days.

1/ Patient was of plus 50 years.

2. Blood pressure, other ailments, kidney, liver and all sorts of body parts , they say were not working properly.

3.  Reasons/ Results and further treatment of such medical tests conducted were never disclosed.

4. Since the patient was kept in ICU (isolation) no details of catering were ever given.

The question arises that if patient is so sick, then what you  doctor and your team was doing

NO REPLY TO THAT EVER RECEIVED..

5. And finally Body was sent for funeral without telling/taking any bill in the ambulance of hospital.

Is it nor a case of clear cut case of medical negligence?

And the Govt. is funding to them for COVID treatment without proper effective audit as to how, when and why they keep patients in ICU (just to increase the bills) till death.

I don't know when Govt. will rise to catch the signals in puttiong such Doctors, hospital to task.
